e-News® -DHAKA, June 2, 2014 -The hearing of the charges of “crimes against humanity” against Mobarak Hossain, alias Mobarak Ali, an alleged Razakar commander from Brahmanbaria, ended here today at International Crimes Tribunal (ICT)-1 with a ruling that the verdict would be delivered any day.
The ICT-1 put the verdict on CAV (curia advisary vult, a Latin legal term meaning court awaits verdict), drawing an end to
more than a 13 month-long hearing of the case. The ICT-1 on April 23, 2013, indicted Mobarak on five charges of crimes against humanity.
“”Two petitions filed by the prosecution are accepted and we are keeping the date for pronouncing verdict on CAV” said Justice M Enayetur Rahim, chairman of the three-member panel of ICT-1, at 11.18am.
The prosecution filed these two pleas on May 27, one for correcting what seems to be a clerical mistake, where there are two versions of time in formal charge and in the charges that were framed against the accused.
In charge number 3, the time of the incident was mentioned in formal charge as 8 to 9 am, while in the indictment order, it was written as 8 to 9 pm. In another petition, the prosecution pleaded for accepting their explanation given against the query of the ICT-1 on the authenticity of the list.
The defence however sought one-week time on that day for filing their written objection against the pleas. Today advocate Mizanul Islam, counsel for Mobarak, took part in the short hearing. On the other hand, Syed Haider Ali and Md Shahidur Rahman stood for the prosecution.
The prosecution on February 25, 2013, submitted the formal charge against Mobarak and the ICT-1 on March 12 in the same year, took the charges into cognizance. A total of 12 prosecution witnesses have testified against Mobarak, whereas the accused himself and his eldest son Asad Uddin testified as the two defence witnesses.
